STARGATE CONSULTANTS LIMITED LICENCE AGREEMENT FOR THE USE OF THE SCIENCE AND TECHNOLOGY MANAGEMENT BIBLIOGRAPHY -1954-2006

SINGLE USER PRODUCT

This is a legal agreement between you, the end user, and Stargate Consultants Limited of Nanaimo, B.C., Canada.

BY OPENING THE SEALED CD ENVELOPE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT WHICH ARE ALSO CONTAINED IN THE ACCOMPANYING MANUAL. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY RETURN THE UNOPENED CD ENVELOPE AND THE ACCOMPANYING DOCUMENTATION TO THE PLACE YOU OBTAINED THEM FOR A FULL REFUND.

GRANT OF LICENCE

On-Line Format

Stargate Consultants Limited grants you the right to use the On-line version of the Science and Technology Management Bibliography (if you have so purchased) for the period of the agreement between you and Stargate Consultants Limited. You may give your password to registered students in the "management of technology" courses that you, the end-user, teach at your educational institution so that the registered students may use the bibliography for the period of the agreement.

CD Format

If you have purchased the Science and Technology Bibliography on CD only, Stargate Consultants Limited grants you the right to use one copy of the enclosed Stargate software program (the "SOFTWARE") on a single terminal connected to a single computer (i.e., with a single CPU). You may not network the SOFTWARE or otherwise use it on more than one computer or computer terminal at a time. You may either make one copy of the SOFTWARE solely for backup or archival purposes, or transfer the SOFTWARE to a single hard drive provided you keep the original CD solely for backup or archival purposes. You may not copy the Product Manual or written materials accompanying the SOFTWARE.

A multi-user/intranet licence is available.

COPYRIGHT

The COPYRIGHT TO ALL VERSIONS of Science and Technology Management Bibliography is owned by Stargate Consultants Limited and is protected by Canadian and U.S. copyright laws, international treaty provisions and all other applicable national laws.

Any downloaded files on to a disk or computer hard drive from the Stargate web-site must be for personal use only.

You may print out the individual files and create a "book" but the printed copy of the "book" must be for personal use only, including being made available to students registered in the end-user's course on "management of technology".

You may not rent or lease the SOFTWARE or put the Science and Technology Management Bibliography up on your or anybody else's web-site or intra-net, but you may transfer your rights under this Stargate Licence Agreement on a permanent basis provided you transfer all copies of the SOFTWARE and all written materials, and the recipient agrees to the terms of this Agreement.. You may not reverse engineer, decompile, or disassemble the SOFTWARE. You may add references titles to either the RTF or WordPerfect CD versions for your personal use, however this does not constitute the creation of a "new" book not subject to the Stargate Licence Agreement.

LIMITED WARRANTY

Stargate Consultants Limited warrants that the SOFTWARE will perform substantially in accordance with the accompanying Product Manual for a period of ninety days from the date of receipt.

Stargate Consultants Limited's entire liability and your exclusive remedy shall be, at Stargate's option, either to refund the purchase price paid, or replace any defective CD. Returned CDs should be accompanied by a copy of the original invoice.

STARGATE CONSULTANTS LIMITED DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OR MERCHANT LIABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE OR THE ACCOMPANYING WRITTEN MATERIALS. THE LIMITED WARRANTY GIVES YOU SPECIFIC RIGHTS.

IN NO EVENT SHALL STARGATE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS STARGATE PRODUCT, EVEN IF STARGATE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. STARGATE'S ENTIRE LIABILITY UNDER ANY PROVISIONS OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR USE OF EITHER THE ON-LINE OR CD VERSION OF THE SCIENCE AND TECHNOLOGY MANAGEMENT BIBLIOGRAPHY.
